Cannabis Laws in California

Sacramento Cannabis Lawyer with Over a Decade of Experience

Cannabis is a new field of law. While before it was strictly illegal and off limits to anyone and everyone, there are now rules that specify who can be in possession and how much they can possess at a given time. Your ability to legally own cannabis is important to understand, especially if you were charged with a drug crime involving the substance. At Donato Legal Group, our Sacramento marijuana crime defense lawyer has the experience, in-depth knowledge, and insights to help you protect your business. If you were charged with a crime involving cannabis, get help from our team.

Who Can Possess Marijuana?

Thanks to the recent Prop 64 laws, people over 21 are able to buy cannabis without a medical recommendation. This means that so long as you are not in possession of an amount over the legal limit, you are operating within the law. However, this does not stop some police officers from alleging that you were doing something illegal. It is important that you have the help of an experienced legal representative on your side to help you prove your innocence.

In California, it is illegal to use marijuana while:

  • Driving a car
  • Visiting a public place that is not licensed for cannabis consumption
  • At a school, daycare center, or youth center

You are also prohibited from growing marijuana anywhere that is visible to the public. You also cannot provide marijuana to anyone under the age of 21. The legal possession amount is 28.5 grams, which is about 1 ounce.

What are the Penalties for the Unlawful Cultivation of Marijuana?

Under Proposition 64, it is lawful for adults over the age of 21 to grow up to six marijuana plants. Unlawful cultivation of marijuana (6 plants or more) is a misdemeanor charge and punishable by up to 6 months in jail and a $500 fine.

How We Can Help

Attorney Alan Donato has experience with some of the earliest iterations of California’s cannabis laws. He is a member of Americans for Safe Access and the National Organization for the Reform of Marijuana Laws, giving him extensive insights on how the law affects people. His understanding of cannabis statutes has helped him build strong cases for his clients. If you were arrested on cannabis charges, Donato Legal Group may be able to help you have those charges reduced or, in some cases, even dropped.

During your consultation, we will work with you to understand what happened and how to proceed with your defense. County, state, and federal prosecutors may be assigned to your case, and they will do what they can to secure a conviction. You need someone on your side who can help you stand strong and protect yourself. Call Donato Legal Group today to get started.
